General terms and conditions for online tickets

These General Terms and Conditions (GTC) apply to the purchase of tickets in electronic business transactions, optionally as mobile tickets or as printable eTickets, for events organised by Kirsch Import Marketing GmbH (hereinafter referred to as KIM). If the customer breaches the obligations under these General Terms and Conditions, KIM is entitled to exclude the customer from using the relevant KIM service in whole or in part or to terminate the contractual relationship extraordinarily by KIM. The claim to remuneration remains unaffected by this.

These GTC of KIM apply exclusively; KIM does not recognise any terms and conditions of the customer that conflict with or deviate from these GTC unless their validity has been expressly agreed. These GTC shall also apply if the service is performed in the knowledge of conflicting or deviating terms and conditions.

1. Conclusion of contract 
The offer to conclude a contract on the part of the customer is made by providing the correct address and all necessary data for payment processing. The provision of all data ensures that the customer must confirm the accuracy of a summary of the data again before clicking on the ‘Order’ button. KIM accepts the offer by sending a confirmation message to the customer by e-mail, i.e. the contract is concluded with the e-mail confirmation. This process is handled via Eventbrite.

2. Offers and prices 
Offers and prices are always subject to change. All prices are inclusive of statutory VAT. Delivery and shipping costs as well as other costs are generally not incurred. 

 

3. Payment 
Payment for tickets is made by credit card, PayPal or instant bank transfer. Payment is due immediately without deduction.

4. Cancellation for visitors or return of tickets 
A return of the tickets is excluded in accordance with § 312g paragraph 2 No. 9 BGB as well as a cancellation of the contract. Every ticket order is therefore binding immediately after confirmation by KIM in accordance with section 1 and obliges the customer to accept and pay for the tickets ordered.

5. Tickets 
Customers have the option of ordering a Mobile Ticket and/or a printable eTicket. 

​

Once the contract has been concluded and payment has been made, an eTicket will be displayed immediately for printing. The customer should utilise this printing option immediately. If the customer destroys or damages the printed exhibitor pass/ticket through no fault of his/her own, the customer is entitled to print out the exhibitor pass/ticket again. The customer will automatically receive an e-mail for this purpose after conclusion of the contract.

Customers may only make one printed copy of the eTicket they have ordered for the purpose of using it as intended. 

​

Customers are not authorised to reproduce, duplicate or modify tickets in any form whatsoever. An unauthorised reproduced ticket does not entitle the customer to enter the event. 

In the event that reproductions, duplications, alterations or other unauthorised versions of the purchased ticket appear, KIM reserves the right to deny the owners or holders of such tickets access to the event. Furthermore, KIM reserves the right to demand payment of the total value of such tickets as well as compensation for any damages (including financial losses and/or costs of legal defence or prosecution). 


KIM is not liable for any inconvenience and/or damage caused by the reproduction, duplication, alteration or other misuse of tickets.

The resale of tickets purchased as part of this procedure to third parties is not permitted. The single-use QR code on the ticket is electronically validated at the event venue using a QR code scanner. No other persons may gain access to the event by copying the QR code using the same QR code.

​

KIM reserves the right to report any violation of the provisions in section 5 of these GTC and to prosecute the offender. 


Tickets must be kept in a safe place to prevent misuse. KIM will not provide a replacement if the ticket is lost. 

​

In the case of trade visitor tickets, we reserve the right to subsequently request proof of identity for trade visitors and to cancel tickets already purchased in the absence of proof of identity.

6. Data protection 
The data is processed by KIM, also with the help of service providers, for the purpose of contract fulfilment. In addition, KIM uses customer data for customer service purposes on the basis of Article 6 (1) (f) of the European General Data Protection Regulation, in particular to send customers event-specific information about the events they have attended by email. This is done strictly in compliance with the current data protection laws.

Customers have the right to information, correction, deletion or blocking of their personal data. If they wish their personal data stored by KIM to be deleted, this request will be complied with immediately, provided that deletion does not conflict with documentation or retention obligations. 


Customers can object to the use of their personal data for the above-mentioned purposes at any time or revoke any consent they have given.

7. Conclusive provisions 
Amendments and additions to these GTC must be mutually confirmed in writing to be effective. Verbal collateral agreements are not legally effective. This also applies to the waiver of this written form clause. 

Should any provision of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

German law shall apply. 

​

If the customer acts as a merchant, a legal entity under public law or a special fund under public law with its registered office in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of the seller. If the customer is domiciled outside the territory of the Federal Republic of Germany, the place of business of the seller shall be the exclusive place of jurisdiction for all disputes arising from this contract. In the above cases, however, the seller is in any case entitled to appeal to the court at the customer's place of business.
